Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of Botfolio, including its website, user accounts, design gallery, team profiles, comments, tags, downloads, artificial intelligence features, and related services (collectively, the “Service”).

Botfolio is operated by Botfolio LLC, a North Carolina limited liability company. References in these Terms to “Botfolio,” “we,” “us,” and “our” mean Botfolio LLC.

By creating an account, uploading content, accessing features that require acceptance of these Terms, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not create an account or use the Service.

1. Age Requirements

You must be at least 13 years old to create a Botfolio account. If you are under 18 years old, you represent that you have permission from your parent or legal guardian to create an account and use Botfolio, including its AI-assisted design review features.

Botfolio LLC may suspend, restrict, or delete an account if we learn that the user is under 13, provided false age information, or otherwise does not satisfy these requirements.

2. Educational Purpose

Botfolio is an educational platform intended to enable users to share, view, download, analyze, and discuss robotics designs, ideas, images, CAD files, technical information, and related content.

Botfolio does not independently test, inspect, approve, certify, or guarantee user-submitted designs, CAD files, technical information, instructions, or other content made available through the Service. Content available through Botfolio is provided for informational and educational purposes and does not constitute professional engineering, safety, legal, medical, or competition-rules advice.

Users are responsible for independently evaluating information obtained through Botfolio before relying upon it or using it to design, build, modify, test, maintain, or operate any robot, mechanism, component, or other device.

3. User Accounts

You agree to provide accurate account information and to maintain the security and confidentiality of your account credentials. You are responsible for activity conducted through your account and agree not to share your password or knowingly permit another person to use your account in an unauthorized manner.

You must promptly notify Botfolio if you believe your account has been compromised, accessed without authorization, or otherwise subjected to a security concern.

You may not impersonate another person, team, school, organization, company, or other entity, or falsely represent your identity, qualifications, authority, team membership, or affiliation with another person or organization.

Botfolio may restrict, suspend, or terminate accounts used in connection with abuse, fraud, spam, infringement, unsafe conduct, unlawful activity, security violations, or violations of these Terms or our Community Rules.

4. User-Submitted Content

For purposes of these Terms, “User Content” means designs, CAD files, photographs, drawings, images, descriptions, documentation, links, comments, tags, profile information, team information, and any other material submitted, uploaded, posted, transmitted, or otherwise made available through Botfolio.

You retain ownership of User Content that you own. Submitting User Content to Botfolio does not, by itself, transfer ownership of that content to Botfolio LLC.

By submitting User Content, however, you grant Botfolio LLC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, resize, convert, format, process, display, distribute, organize, analyze, moderate, and make that User Content available through Botfolio as reasonably necessary to operate, maintain, improve, secure, and promote the Service.

This license also permits Botfolio to generate technical previews, thumbnails, rendered views, metadata, or other representations of User Content when reasonably necessary to display, process, analyze, moderate, or provide features associated with that content.

The license granted to Botfolio generally ends when the applicable User Content is permanently deleted from our active systems. Notwithstanding the foregoing, copies may remain temporarily in routine backups until those backups expire through their normal retention cycle. Botfolio may also retain limited information reasonably necessary for legal, security, copyright, moderation, fraud-prevention, or dispute-resolution purposes. In addition, content that has previously been downloaded, copied, or shared by other users or third parties may remain outside Botfolio’s possession or control and may not be capable of being retrieved or deleted by Botfolio.

Nothing in these Terms grants Botfolio ownership of User Content merely because that content has been submitted to or made available through the Service.

5. Your Responsibilities When Uploading Content

By submitting User Content, you represent and warrant that you created the content or otherwise possess all rights, licenses, consents, and permissions reasonably necessary to submit and publicly share the content through Botfolio.

Where applicable, this includes permission reasonably required from your team, school, organization, sponsor, collaborator, employer, owner, or any other person or entity that possesses rights in or restrictions applicable to the content.

You further represent and warrant that your User Content does not violate or misappropriate another person’s copyright, trademark, privacy, publicity, contractual, confidentiality, or other rights; does not contain confidential, proprietary, stolen, restricted, or improperly obtained team or third-party information; and does not contain private personal information such as home addresses, private telephone numbers, passwords, API keys, school schedules, or other sensitive information that should not be publicly disclosed.

You also represent and warrant that your User Content does not contain malware, malicious code, or files intentionally designed to compromise a computer, account, system, or network; does not contain intentionally dangerous instructions designed to cause injury, property damage, or unlawful conduct; does not contain unlawful, exploitative, or otherwise prohibited content; and may lawfully be submitted and made available through Botfolio.

If User Content contains an identifiable person in an image, video, or other media, you represent that you have any permission reasonably necessary to submit, use, and publicly display that material through the Service.

Public Sharing and Downloads

Botfolio is a design-sharing platform. By submitting User Content for public display, you understand and acknowledge that the content may be viewed, discussed, analyzed, copied, or downloaded by other users.

Once another person has downloaded, copied, exported, or independently saved publicly available User Content, Botfolio may be unable to retrieve, restrict, or delete that copy even if the original content is subsequently removed from Botfolio.

You should not upload confidential designs, private team CAD files, proprietary information, restricted information, or other material that you, your team, or another rights holder does not want made publicly available.

6. Safety Warning

Robotics design, construction, testing, maintenance, and operation may involve batteries, electricity, motors, power tools, moving mechanisms, sharp objects, pinch points, stored energy, projectiles, heat, elevated loads, and other hazards that may cause injury or property damage if not properly understood and controlled.

You are responsible for independently evaluating every design before building, modifying, testing, or using it. You are also responsible for obtaining appropriate adult or qualified supervision, following applicable manufacturer instructions, using appropriate personal protective equipment, complying with applicable laws and competition rules, and safely designing, building, testing, maintaining, and operating any mechanism.

Botfolio does not represent or warrant that any design, CAD file, instruction, recommendation, or other content is safe, reliable, structurally adequate, dimensionally accurate, suitable for a particular purpose, competition-legal, free from defects, or appropriate for your particular application.

You use Botfolio content and downloads at your own risk.

7. Artificial Intelligence Features

Botfolio may use artificial intelligence to provide design reviews, scores, suggestions, summaries, classifications, identified concerns, recommendations, or other feedback. AI-assisted reviews may use design descriptions, images, rendered views, CAD-derived information, technical metadata, and other information associated with a submitted design.

AI-generated information may be incomplete, inaccurate, outdated, misleading, or inappropriate for a particular design, robot, mechanism, application, or competition.

Unless Botfolio expressly states otherwise with respect to a particular feature, an AI-assisted review does not constitute professional engineering analysis and does not perform or provide dimensional inspection, tolerance or stack-up analysis, structural or finite-element analysis, collision or interference validation, electrical or battery-safety certification, manufacturing validation, safety certification, or official competition-rule verification.

AI-generated information is not a substitute for qualified engineering judgment, adult supervision, physical inspection, testing, manufacturer instructions, appropriate safety review, or consultation of the official rules applicable to a competition.

You are responsible for independently reviewing, testing, and verifying AI-generated information before relying upon or acting upon it.

8. Prohibited Conduct

You may not use Botfolio in a manner that harms another person, compromises the Service, violates another person’s rights, or violates applicable law.

Without limiting the foregoing, you may not use Botfolio to harass, bully, threaten, intimidate, or abuse another person; publish another person’s private or sensitive information without authorization; upload sexual, exploitative, abusive, or inappropriate content, including content that exploits or endangers a minor; infringe or misappropriate intellectual-property, privacy, contractual, confidentiality, or other rights; or upload confidential, stolen, restricted, or improperly obtained designs or information.

You may not distribute malware, malicious files, destructive code, phishing content, or malicious links through the Service. You may not impersonate another person, team, school, company, or organization; post spam, scams, fraudulent promotions, or deceptive content; manipulate likes, tags, downloads, reports, rankings, accounts, or other community features; or create accounts for the purpose of circumventing a suspension, restriction, or ban.

You also may not bypass or attempt to bypass authentication requirements, access controls, security measures, upload restrictions, or rate limits; scrape, crawl, harvest, or automatically collect Botfolio data without our written authorization; attempt to access another user’s account or restricted information; interfere with, disrupt, overload, damage, or compromise the Service; use the Service to facilitate unlawful or intentionally dangerous conduct; or otherwise violate applicable law, these Terms, or our Community Rules.

9. Moderation and Removal

Botfolio may, but is not required to, monitor, review, investigate, or moderate User Content or user conduct. The fact that content appears on Botfolio does not mean that Botfolio has reviewed, verified, approved, endorsed, or certified it.

We may hide, restrict, preserve, remove, restore, or otherwise moderate User Content and may warn, restrict, suspend, or terminate users or accounts when we reasonably believe that content or conduct violates these Terms or our Community Rules; presents a safety or security risk; infringes or may infringe another person’s rights; exposes private or sensitive information; contains malware or malicious content; may violate applicable law; interferes with operation of the Service; or may harm Botfolio, its users, or others.

Botfolio may temporarily restrict or hide content while investigating a report or determining whether further action is appropriate.

Botfolio is not responsible for continuously monitoring all User Content or identifying every violation, error, safety concern, infringement, or instance of inappropriate conduct. Users may report suspected violations through reporting tools provided through the Service or by contacting Botfolio through the appropriate contact channel.

10. Copyright Complaints

Botfolio respects the intellectual-property rights of others. Users may not upload or otherwise make available through the Service material that infringes another person’s copyright or other intellectual-property rights.

Copyright owners or their authorized representatives may submit complaints in accordance with our Copyright and Takedown Policy. Botfolio may restrict, preserve, disable access to, or remove allegedly infringing material while a complaint is reviewed and may suspend or terminate accounts of repeat infringers when appropriate.

11. Downloads and Third-Party Links

Files, designs, links, and other resources available through Botfolio may be submitted by users or provided by third parties. Botfolio does not guarantee that such content is accurate, complete, secure, compatible, functional, safe, suitable for a particular use, or free from malware or other harmful content.

You are responsible for scanning downloaded files before opening or using them, independently evaluating downloaded designs and information, maintaining appropriate security software, reviewing external websites before providing information to them, and determining whether downloaded material is suitable and safe for your intended use.

Botfolio may provide links to websites and services that we do not own or control. Third-party websites and services are governed by their own terms, policies, security practices, and privacy practices, and Botfolio is not responsible for those third-party services.

12. Privacy

Your use of Botfolio is also governed by our Privacy Policy, which explains the types of information Botfolio collects, how information is used and shared, how certain information may be retained, and how users may request account or content deletion.

Account and content deletion remain subject to applicable retention requirements and Botfolio’s legitimate needs relating to security, moderation, copyright, legal compliance, fraud prevention, policy enforcement, and dispute resolution.

Information that has previously been downloaded or independently copied by another person may remain outside Botfolio’s control after the original content is deleted.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOTFOLIO LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, RELIABILITY, AVAILABILITY, AND SECURITY.

Without limiting the foregoing, Botfolio LLC does not warrant that the Service will always be available, uninterrupted, secure, or error-free; that User Content will be accurate, complete, original, reliable, or lawful; that files will be free from malware or other harmful components; that a particular design will operate or function as intended; that a design will be safe or suitable for a particular application; that a design will comply with applicable competition rules; that AI-generated information will be complete or correct; that information or data will never be lost; or that every defect, vulnerability, error, or security issue will be identified or corrected.

Some jurisdictions may not permit the exclusion of certain warranties. In those jurisdictions, the foregoing exclusions apply only to the fullest extent permitted by applicable law.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOTFOLIO LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRIBUTORS, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

Without limiting the foregoing, this limitation applies to damages arising from or relating to your access to, use of, or inability to use Botfolio; reliance upon a design, CAD file, download, comment, AI response, or other content; the construction, testing, operation, malfunction, or failure of a robot or mechanism; personal injury or property damage related to User Content; unauthorized access to or use of an account; loss, corruption, alteration, or deletion of data; competition penalties, disqualification, or other competition-related consequences; the conduct or content of another user; or third-party websites, services, products, files, or information.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF BOTFOLIO LLC ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO BOTFOLIO LLC FOR USE OF THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.

15. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Botfolio LLC and its members, officers, employees, contractors, contributors, agents, and service providers from and against claims, liabilities, damages, losses, judgments, costs, and reasonable expenses arising out of or relating to your User Content, your misuse of the Service, your violation of these Terms, your violation of applicable law, or your infringement or violation of another person’s rights.

This provision applies only to the extent permitted by applicable law.

16. Account Suspension and Termination

You may stop using Botfolio at any time and may request deletion of your account through the methods described in the Service or our Privacy Policy.

Botfolio may restrict, suspend, or terminate your account when we reasonably believe that you have violated these Terms, our Community Rules, applicable law, another person’s rights, or applicable security requirements, or when your conduct creates material risk for Botfolio, its users, or others.

Botfolio may also restrict or terminate accounts associated with repeated infringement, serious abuse, malicious activity, fraud, security threats, attempts to evade prior enforcement, or other conduct reasonably determined to threaten the integrity or safety of the Service.

Account and content deletion are subject to our Privacy Policy, applicable retention requirements, moderation and security records, copyright requirements, and the treatment of User Content described in these Terms.

17. Changes to the Service

Botfolio may modify, improve, add, remove, restrict, suspend, or discontinue features or portions of the Service from time to time.

We do not guarantee that any specific feature, design, file, AI capability, content type, or other functionality will remain available indefinitely, and we may make changes that affect the manner in which content or features are made available.

18. Changes to These Terms

We may update these Terms from time to time. Any updated version will identify a new effective date.

If a change is material, Botfolio may provide notice through the Service, by email, through an account notice, or by requesting acceptance of the revised Terms. Continued use of the Service after revised Terms become effective may constitute acceptance of the revised Terms to the extent permitted by applicable law.

Where Botfolio determines that affirmative acceptance is appropriate, continued access to certain account features may require acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict-of-law principles.

Nothing in this provision deprives a consumer of any protection or right that cannot lawfully be waived under applicable law.

20. Severability

If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law. If it cannot be so enforced, it shall be severed to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

21. No Waiver

Botfolio’s failure or delay in exercising or enforcing any provision of these Terms or any right available to it shall not constitute a waiver of that provision or right, nor shall any waiver of a particular violation constitute a waiver of any subsequent violation.

22. Entire Agreement

These Terms, together with our Privacy Policy, Community Rules, Copyright and Takedown Policy, and any other policies expressly incorporated by reference, constitute the agreement between you and Botfolio LLC concerning your use of the Service and supersede prior or contemporaneous understandings relating to that use to the extent addressed by these Terms.
